From our experience, we know how essential it is to guide the customer step by step through the homebuying process, which varies significantly from one country to another.

In Anglo-Saxon countries, for example, it is common for the customer to present a “formal offer” and only afterward hire a lawyer to handle legal matters.

The Anglo-Saxon approach is completely different from the Italian system.

In Italy, once accepted by the seller, the formal offer automatically becomes a preliminary sales agreement, which is equivalent to a binding contract—far more binding than a simple accepted offer.

To avoid complications and major issues during the buying process, it is essential for the client to be supported by a solicitor from the very beginning, ensuring the process runs safely and smoothly.

When it comes to significant investments, drafting a preliminary agreement is a key step. It gives the client a high level of security and ensures that the seller respects the agreements written in the preliminary deed.

A Trust, in particular, requires specific clauses. The tusk of the solicitor is to transform the Trust’s requirements into precise contractual clauses, ensuring they are compliant with the client’s investment goals and with the Italian law.
